§ 1 Information on the collection of personal data

(1) Below we inform you about the collection of personal data when using our website. Personal data is any data that can be related to you personally, e.g. name, address, email addresses, user behavior.

(2) The controller pursuant to Article 4(7) of the EU General Data Protection Regulation (GDPR) is DGN Fashion GmbH, Modering 11, 22457 Hamburg, represented by the managing directors Kazim Can and Mehmet Emin Dogan, Hamburg Local Court HRB 17191, VAT ID: DE118567351. (3) When you contact us by email or via a contact form, the data you provide (your email address, and optionally your name and telephone number) will be stored by us in order to answer your questions. We will delete the data collected in this context once storage is no longer necessary, or restrict processing if there are statutory retention obligations.

(4) If we use contracted service providers for individual functions of our service or wish to use your data for advertising purposes, we will inform you in detail about the respective processes below. We will also specify the defined criteria for the storage period.

§ 2 Your rights

(1) You have the following rights with respect to your personal data:

- Right to rectification or erasure,
- Right to restriction of processing,
- Right to object to processing,
- Right to data portability.

(2) You also have the right to lodge a complaint with a data protection supervisory authority regarding our processing of your personal data.

Section 3 Collection of personal data when visiting our website

(1) When you use our website for purely informational purposes, i.e., if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure its stability and security (legal basis is Art. 6 para. 1 sentence 1 lit. f GDPR):

- Date and time of the request
- Time zone difference to Greenwich Mean Time (GMT)
- Content of the request (specific page)
- Access status/HTTP status code
- Amount of data transferred in each case
- Website from which the request originates
- Browser
- Operating system and its interface
- Language and version of the browser software.

(2) In addition to the data mentioned above, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard drive and assigned to the browser you are using. They allow the entity that sets the cookie (in this case, us) to receive certain information. Cookies cannot run programs or transmit viruses to your computer. They serve to make the overall internet experience more user-friendly and effective.

(3) Use of cookies:

b) Transient cookies are automatically deleted when you close your browser. These include session cookies. f) We use cookies to identify you on subsequent visits if you have an account with us. Otherwise, you would have to log in again each time you visit.

g) The Flash cookies used are not recorded by your browser, but by your Flash plug-in. We also use HTML5 storage objects, which are stored on your device. These objects store the necessary data independently of your browser and do not have an automatic expiration date. § 4 Further functions and offers of our website

(1) In addition to the purely informational use of our website, we offer various services that you can use if you are interested. For this, you will generally need to provide further personal data, which we use to provide the respective service and for which the aforementioned data processing principles apply.

(2) In some cases, we use external service providers to process your data. These providers have been carefully selected and commissioned by us, are bound by our instructions, and are regularly monitored.

(3) We may also share your personal data with third parties if we offer promotions, contests, contracts, or similar services jointly with partners. You will receive more detailed information when you provide your personal data or below in the description of the offer.

(4) If our service providers or partners are located in a country outside the European Economic Area (EEA), we will inform you about the consequences of this in the description of the offer.

§ 5 Objection or revocation to the processing of your data

(1) If you have given your consent to the processing of your data, you can withdraw it at any time. Such a withdrawal will affect the lawfulness of the processing of your personal data after you have communicated it to us.

(2) Where we base the processing of your personal data on a balancing of interests, you may object to the processing. This is the case, in particular, if the processing is not necessary for the performance of a contract with you, which we will explain in the following description of the functions. When exercising such an objection, please state the reasons why we should not process your personal data as we have done. In the event of your justified objection, we will review the situation and either cease or adjust the data processing or demonstrate to you our compelling legitimate grounds for continuing the processing.

§ 6 Use of our webshop

(1) If you wish to place an order in our online shop, it is necessary for the conclusion of the contract that you provide your personal data, which we require for processing your order. Mandatory information required for processing the contract is marked accordingly; other information is voluntary. We process the data you provide to process your order. For this purpose, we may pass on your payment data to our service providers for shipping or payment processing. The legal basis for this is Article 6(1)(b) GDPR.

When paying via PayPal, direct debit, credit card, purchase on account or installment payment (Powered by PayPal), we will provide your payment details to PayPal (Europe) Sarl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg as part of the payment processing.

PayPal reserves the right to conduct a credit check for the aforementioned payment methods. For this purpose, your payment data may be forwarded to credit agencies in accordance with Art. 6 Para. 1 Sentence 1 lit. f GDPR, based on PayPal's legitimate interest in assessing your creditworthiness. PayPal uses the result of the credit check, specifically the statistical probability of payment default, to decide whether to offer the respective payment method. The credit check may include probability values ​​(so-called score values). If score values ​​are included in the result of the credit check, they are based on a scientifically recognized mathematical-statistical procedure. Address data is among the data used, but not the only data, in the calculation of the score values. You can object to this processing of your data at any time by sending a message to PayPal. However, PayPal may still be entitled to process your personal data if this is necessary for the contractual processing of payments.

(2) We may also process the data you provide to inform you about other interesting products from our portfolio or to send you emails with technical information.

(3) We are obliged under commercial and tax law to store your address, payment and order data for a period of ten years.

(4) To prevent unauthorized access by third parties to your personal data, in particular financial data, the ordering process is encrypted.

§ 7 Newsletter

(1) With your consent you can subscribe to our newsletter, which will inform you about our current interesting offers.

(2) We use the so-called double opt-in procedure for newsletter registration. This means that after you register, we will send an email to the email address you provided, asking you to confirm that you wish to receive the newsletter. If you do not confirm your registration within 24 hours, your information will be blocked and automatically deleted after one month. We also store your IP address and the date and time of registration and confirmation. The purpose of this procedure is to be able to verify your registration and, if necessary, investigate any potential misuse of your personal data.

(3) The only mandatory information required to receive the newsletter is your email address. Providing further, separately marked data is voluntary and is used to personalize our communication with you. After your confirmation, we will store your email address for the purpose of sending you the newsletter. The legal basis for this is Article 6(1)(a) GDPR.

(4) You can withdraw your consent to receive the newsletter and unsubscribe at any time. You can do this by clicking on the link provided in every newsletter email or by sending a message to the contact details provided in the legal notice.

(5) Please note that we analyze your user behavior when sending newsletters. For this analysis, the emails we send contain so-called web beacons or tracking pixels, which are single-pixel image files stored on our website. For the analysis, we link the data mentioned in Section 3 and the web beacons to your email address and a unique ID. The data is collected exclusively in pseudonymized form; the IDs are not linked to your other personal data, thus preventing any direct identification of individuals.

You can object to this tracking at any time by clicking the separate link provided in each email or by contacting us through another channel. The information will be stored for as long as you are subscribed to the newsletter. After you unsubscribe, we will store the data for purely statistical and anonymous purposes.

§ 8 Web Analytics

Use of Google Analytics

(1) This website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses "cookies," which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website will generally be transmitted to and stored by Google on servers in the United States. However, if IP anonymization is activated on this website, your IP address will be shortened by Google beforehand within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. (4) This website uses Google Analytics with the extension “_anonymizeIp()”. This shortens IP addresses before further processing, thus preventing them from being linked to a specific individual. Therefore, any personal data collected about you is immediately anonymized and the personal data is promptly deleted.

(5) We use Google Analytics to analyze and regularly improve the use of our website. The statistics we gather allow us to improve our services and make them more interesting for you as a user. For the exceptional cases in which personal data is transferred to the USA, Google has submitted to the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US-Framework .
