Scope

General Terms and Conditions (GTC)

1. Scope

(1) For all business relationships and contracts concluded via the online shop of the
DGN Fashion GmbH , Modering 5, 22457 Hamburg, Germany
(hereinafter “DGN FASHION”)
These General Terms and Conditions (GTC) apply exclusively to all contracts concluded with the customer (hereinafter referred to as "Customer") in the version valid at the time of the order.

(2) Any differing, conflicting or supplementary terms and conditions of the customer shall not become part of the contract unless DGN FASHION expressly agrees to their validity in text form (e.g. by e-mail).

(3) The offer is directed at both consumers and businesses. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.

2. Conclusion of the contract

(1) The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to the customer to place an order.

(2) By submitting the order, the customer makes a binding offer to conclude a purchase agreement.

(3) The contract is only concluded when DGN FASHION accepts the order. Acceptance occurs through dispatch of the goods or through an express declaration of acceptance in written form.

(4) DGN FASHION is entitled to refuse orders in whole or in part, in particular if
– goods are unavailable,
– the customer provides false information or
– outstanding receivables from previous business relationships exist.

(5) Goods shall only be supplied in commercially available quantities.

 

3. Prices and payment methods

(1) All prices are quoted in euros and include statutory VAT.

(2) The following payment methods are available (some only for customers from Germany, subject to credit check):

  • Purchase on account*
  • Installment payment*
  • Credit card (Visa, Mastercard)
  • Direct debit*
  • Instant bank transfer*
  • Giropay*
  • PayPal

(* Payment methods may be excluded after a credit check.)

(3) An automatic credit check may be performed during the ordering process. DGN FASHION reserves the right to exclude certain payment methods depending on the result.

(4) When paying via PayPal, payment processing is carried out via PayPal (Europe) S.à rl et Cie, SCA, Luxembourg.
When purchasing on account, payment processing is handled by Ratepay GmbH; in this case, Ratepay is the creditor.

4. Shipping, delivery and shipping costs

4.1 Delivery

(1) Delivery will be made to the delivery address specified by the customer during the ordering process.

(2) Unless otherwise stated, delivery usually takes place within 3–5 working days , subject to availability. Delivery times are non-binding guidelines and do not constitute a guaranteed delivery date.

4.2 Shipping costs (outbound)

  • Germany:
    Free shipping on orders over €150.00 (standard shipping)
    For amounts under €150.00, a flat fee of €10.00 applies.
  • European Union:
    Free shipping on orders over €250.00 (standard shipping)
    For amounts under €250.00, a flat fee of €15.00 applies.

Free shipping applies exclusively to outbound shipments .

 

4.3 Delivery countries within the EU

Deliveries within the European Union are made to the following countries:

Belgium, Bulgaria, Denmark, Estonia, Finland, Greece, Ireland, Italy, France, Croatia, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Austria, Poland, Portugal, Romania, Sweden, Slovakia, Slovenia, Spain, Czech Republic, Hungary, Cyprus.

4.4 Customs duties, taxes and import duties (EU & non-EU)

(1) For deliveries within the European Union (EU) , additional costs may be incurred depending on the country of destination, in particular country-specific taxes, duties or other charges.
These costs are not included in the purchase price and must be borne entirely by the customer .

(2) For deliveries outside the European Union (non-EU countries), in particular customs duties, import VAT, handling fees, charges from customs or shipping service providers and other public charges may apply.

(3) DGN FASHION accepts no responsibility or liability for these additional costs.
All costs incurred in connection with the import shall be borne exclusively by the customer.

(4) Reimbursement or assumption of such costs by DGN FASHION is excluded.

(5) The responsibility for compliance with the respective import and customs regulations of the destination country lies exclusively with the customer.

5. Retention of title

The goods remain the property of DGN FASHION until full payment is received.

6. Right of withdrawal and return

(1) Consumers have a statutory right of withdrawal of 14 days for non-reduced goods in accordance with the separate cancellation policy.

(2) Exclusion for discounted goods (Sale):
Reduced items (sale items) are excluded from exchange and return.
There is no right of withdrawal for discounted goods.

(3) By placing the order, the customer expressly acknowledges this provision.

7. Return shipping costs

(1) The customer shall generally bear the costs of return shipping.

(2) This applies regardless of the country of delivery, including Germany.

(3) DGN FASHION does not cover return shipping costs.
Free returns are not offered.

(4) Free shipping on the outbound shipment does not entitle the recipient to a free return shipment .

8. Warranty

The warranty is governed by statutory regulations.

9. Liability

(1) DGN FASHION shall be liable without limitation in cases of intent and gross negligence.

(2) In cases of simple negligence, DGN FASHION shall only be liable for breaches of essential contractual obligations and only to the extent of foreseeable damages.

(3) Liability under the Product Liability Act remains unaffected.

10. Online Dispute Resolution

The EU Commission provides a platform for online dispute resolution:

DGN FASHION is neither obligated nor willing to participate in dispute resolution proceedings.

11. Copyright

All content on this website is protected by copyright. Use without permission is prohibited.

12. Final Provisions

(1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) The place of jurisdiction and performance is Hamburg, provided the customer is a merchant.

(3) Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
